TLI Top Tip: Filing Requirements for New or Updated Websites

 In Texas, an “advertisement” is “a communication substantially motivated by pecuniary gain that is made by or on behalf of a lawyer to members of the public in general, which offers or promotes legal services under circumstances where the lawyer neither knows nor reasonably should know that the recipients need legal services in particular matters.”  Texas Disciplinary Rule of Professional Conduct 7.01(b)(1)

Unless exempted, attorney advertisements that meet this definition must be filed with the Advertising Review Committee no later than ten (10) days after the date the attorney disseminates them. TDRPC 7.04(a).  Failure to make this filing is a violation of Rule 7.04, even if the ad or writing complies with the disciplinary rules in all other respects.
