You can hardly watch tv or listen to the radio for more than five minutes without seeing or hearing an ad by an attorney marketing his or her legal services. Whether accurate or not, it seems the number of different ads and the frequency with which they run has dramatically increased in the last several years.  Other forms of promotion also appear to be on the rise, including billboards, social media, digital ads and print ads. However, regardless of the medium, all communications regarding a lawyer’s services that are motivated by pecuniary gain must meet the requirements of Texas Disciplinary Rules of Professional Conduct 7.01, 7.02, 7.03 and 7.04.  Below are some common pitfalls:
