In our October 28, 2024 article, we discussed ABA Formal Ethics Opinion 512 regarding the responsible and ethical use of GAI in your law practice. Consistent with Comment 8 to Texas Disciplinary Rule of Professional Conduct 1.01, we advised that lawyers at a minimum need to become aware of the available GAI tools so they can evaluate whether GAI technology may allow them to serve their clients more efficiently while also increasing the quality of their work. To be sure, depending on a number of factors, including the particular facts and circumstances of your client’s legal matter, there is a place for the responsible and ethical use of GAI to assist with the drafting of pleadings, motions and papers provided that certain guardrails are implemented and adhered to.
