TLI Top Tip: Help! I got a letter from the State Bar regarding a Grievance

If you get a letter from the State Bar that a grievance has been filed which requires a response, we recommend you take the following steps:

1. Read the letter, don’t ignore it. 

Failure to respond to a complaint is, in and of itself, a violation of Rule 8.04(a)(8) of the Texas Disciplinary Rules of Professional Conduct. If you receive a letter from the State Bar which informs you that a grievance, classified as a “complaint,” has been filed against you, you must take action.  Within 30 days of when you receive the letter notifying you of a “complaint,”  you are required pursuant to Rule 2.10 of the Texas Rules of Disciplinary Procedure to either: 1) appeal the classification of the grievance as a “complaint” to the Board of Disciplinary Appeals (BODA); or 2) submit a response to the State Bar and send a copy…
