In the third quarter of 2026, TLI closed 25 claims which cost approximately $693,000 to defend and bring to resolution. We are providing summaries of several of the closed claims with lessons learned to further benefit our insureds in their own practices:

 Deadlines and Limitations

Client retained the insured attorney to bring a medical malpractice case against several doctors and a hospital. The attorney filed suit against the doctors believing they were either working in their individual capacities or employed by the hospital. It turned out they were actually employed by a different governmental entity making them government employees. The attorney failed to bring suit, however, against that governmental entity. Although the attorney could have substituted the governmental entity in place of the employee doctors within a certain time period per statute, the attorney failed to make a timely substitution.  Clients hired the insured attorney to file a personal injury suit…
