In the second quarter of 2026, TLI closed 17 claims which cost approximately $941,949.44 to defend and bring to resolution. We are providing summaries of several of the closed claims with lessons learned to further benefit our insureds in their own practices: 

Deadlines and Limitations 

Clients hired insured attorney to file a wrongful death/medical malpractice and survival action suit against the hospital, a doctor, and a nurse (defendants), after the death of the clients’ mother. The insured attorney obtained an expert report to file in support of the malpractice case as required by statute. However, the insured attorney failed to file the report with the court before the deadline. As a result, the defendants filed a motion to dismiss based on the untimely filing of the expert report, which the court granted.   Insured attorney missed the deadline to file a tax appeal by five days. The client asserted a claim against the insured attorney for the amount of the anticipated tax savings.  Lessons Learned: Every quarter since we started this series we have…
