Inspired by Delaware and other jurisdictions, the Texas Legislature created the Business Court of Texas in the 88th Legislature. The Business Court received its first cases in September 2024. HOW DID WE GET HERE?
For the better part of a century, the Chancery Court in Delaware set the standard for business litigation, providing a forum many believed was more expert, more efficient, and more cost-effective for resolving business disputes. In 2023, the 88th Texas Legislature threw Texas’ hat in the dedicated business court ring.
